I am voluntarily participating in the Event(s) with knowledge of the risks, and, upon the express agreement and understanding that, inconsideration of being able to participate in Event(s), I am, for myself, and my legal representatives, heirs and assigns, hereby waiving, releasing, and forever discharging Towson University (the "University”), the University System of Maryland, the State of Maryland, and their directors, officers, agents, servants, contractors, and employees (collectively, the “Released Parties”) from and against any and all such claims, costs, liabilities, expenses, or judgments, including attorneys’ fees and court costs(collectively, “Claims”) arising out of the Event(s) or any illness or injury resulting therefrom and hereby agree to indemnify, defend and hold harmless the Released Parties from and against any and all such Claims by third parties arising out of my activities during such Event(s). I hereby further release the Released Parties from any claim whatsoever on account of any first aid, treatment, service, or service rendered to me during such Event(s).
I understand that there are policies, procedures, rules and regulations in place and for my safety and protection agree to abide by any such established rules or regulations while engaged in the above-referenced Event(s), and agree to comply with all policies, procedures, rules, regulations and standards of conduct fixed by the University, its agents and employees, regarding participation in the Event(s), and I have been fully advised of the activities planned for Event(s). I recognize the risks of illness and injury inherent in such Events, and I voluntarily assume all risks associated with such Event(s). I further understand and agree that situations may arise during these events that may be beyond the control of the University and its agents and employees.
I agree that it is my sole responsibility to be familiar with the physical and/or mental demands associated with the activities planned, and that I have been advised by the University that it is in my best interest to carry or obtain medical insurance. I have no physical impairment, disability, or other medical or mental condition that would medically, mentally, or physically disqualify me from participation in such Event(s). I represent that I am in good health and physically, medically, and mentally able to participate in such Event(s) without danger to myself or to others.
Should I require emergency medical treatment as a result of illness, in juryor accident during the Event(s), I authorize such aid or other treatment as may be necessary under the circumstances, to include treatment by a physician or hospital of which I agree to be solely responsible for any associated cost.
I agree for myself and any successors or assigns that the above representations and agreements are contractually binding and are not mere recitals. This waiver and release may not be modified except by another agreement in writing signed by the University.
I understand that with this waiver and release, I am expressly granting the University permission to use and release any and all photographs, video, likeness, biographical information, voice, statements made by me or other recordings of me or my minor children (if applicable) or property belonging to me or my minor children (if applicable) (the “Materials”) in connection with my participation in the above-referenced event/program, and to and use the Materials produced pursuant to this release in any manner and without restrictions, without inspection or further consent or approval of the finished product or use thereof. I further agree that TU may copyright, copy, modify, alter, duplicate, broadcast and/or distribute any or all such Materials without limitation, through any means whatsoever and for any purpose, including educational and advertisement purposes, and in any medium, including print and/or electronic, without any obligation to me. In consideration of being included in the Materials, I hereby fully and forever release and discharge TU, the University System of Maryland, the State of Maryland, its agents, employees, officers, directors and assigns, from liability for any claims by me or by any third party arising out of or related to use the aforementioned Materials, the use thereof, and/or my participation in the above referenced program/event. I understand that I am free to withdraw my consent in writing for future use at any time without penalty. The University will not be required to notify me prior to using or releasing my likeness.
This waiver and release shall be construed in accordance with the laws of the State of Maryland.
